All participants (or a parent/guardian for minors) must read and agree to this Participant Agreement & Liability Waiver before registering for or participating in any class, workshop, open studio, membership, private lesson, camp, event, or other activity at Claybird Studio, LLC.

I hereby voluntarily waive, release, and discharge any and all claims for personal injury, illness, death, or property damage that I, my guests, or my minor child/children may sustain while participating in activities at or with Claybird Studio, LLC, except to the extent caused by the sole negligence or intentional misconduct of Claybird Studio, LLC.

I understand and agree that:

• This release is intended to discharge and hold harmless Claybird Studio, LLC, its owners, officers, employees, contractors, instructors, volunteers, agents, successors, and assigns from and against any and all liability arising out of or connected with participation in studio activities, except for liability resulting from their sole negligence or intentional misconduct.

• Ceramic activities involve inherent risks, including but not limited to exposure to clay and glaze materials (including crystalline silica), dust, sharp tools, hot equipment and kiln surfaces, lifting heavy materials, slips, trips, falls, repetitive motions, cuts, burns, allergic reactions, and other risks associated with working in a ceramics studio. Claybird Studio follows industry best practices to help minimize these risks through studio design, ventilation, equipment maintenance, cleanup procedures, and safety protocols. I understand that no safety program can eliminate all risks, and I voluntarily assume all inherent risks associated with participation.

• I knowingly and voluntarily choose to participate (or allow my minor child/children or guests to participate) in activities offered by Claybird Studio, LLC and assume full responsibility for any risks of injury, illness, death, or property damage arising from participation.

• This waiver and assumption of risk shall be binding upon me, my heirs, executors, administrators, personal representatives, successors, and assigns.

• I agree to indemnify and hold harmless Claybird Studio, LLC from any loss, liability, damage, cost, or expense, including reasonable attorney fees, arising from claims brought by me, my guests, my minor child/children, or anyone acting on their behalf, except to the extent caused by the sole negligence or intentional misconduct of Claybird Studio, LLC.

• Activities at Claybird Studio are not child care services as defined by the State of New York. Claybird Studio is not responsible for supervising unattended children anywhere on the premises.

• I acknowledge that I have read, understand, and agree to comply with Claybird Studio's Terms, Conditions & Refund Policies and Cleanup & Safety Protocols. I understand that failure to follow studio rules, cleanup procedures, safety protocols, or staff instructions may result in the suspension or revocation of participation, membership, or studio privileges without refund.

• I understand that photographs or videos may be taken during classes, workshops, camps, memberships, Open Studio, or other studio activities as described in Claybird Studio's Terms, Conditions & Refund Policies.

Additional Agreement for Summer Camps, Kids Classes & Programs Involving Minors

I understand that it is my responsibility to provide medical insurance coverage for the child/children named in this registration and to provide accurate and complete medical information.

I certify that all immunizations required by my child's school or local school district are current, or that I have legally exempted my child from such requirements.

In the event of a medical emergency, I authorize Claybird Studio, LLC to obtain emergency medical treatment for my child if I cannot be reached immediately. I understand that every reasonable effort will be made to contact me first and that I am solely responsible for all resulting medical expenses.

Claybird Studio, LLC reserves the right to deny participation or remove any child from a program if, in the sole discretion of the studio, the child's or parent/guardian's behavior:

• Disrupts or interferes with the safe and positive operation of the program;

• Threatens the safety or well-being of participants, staff, volunteers, or visitors;

• Prevents the studio from effectively carrying out its programs; or

• Is otherwise determined to be in the best interest of the child or Claybird Studio, LLC.

Whenever reasonably possible, Claybird Studio will communicate concerns with the parent or guardian before removing a child from a program.

Final Release

I understand that participation in any activity at Claybird Studio, LLC is voluntary.

By registering for or participating in any class, workshop, camp, membership, Open Studio session, private lesson, event, or other activity, I acknowledge that I have carefully read this User Agreement & Liability Waiver, fully understand its contents, understand that I am giving up certain legal rights, and voluntarily agree to be bound by its terms on behalf of myself, my guests, and any minor child/children included in this registration.
